Section 1

Agreement to these terms

These Terms of Service (the “Terms”) are a binding agreement between you and an individual operator based in the State of Georgia, United States, the operator of Ajé Financial (“Ajé,” “we,” “us”). By creating an account or using Ajé, you accept these Terms. If you do not agree to them, do not use Ajé.

Our Privacy Policy explains how we handle your information and forms part of this agreement.

Section 2

What Ajé is

Ajé is a private record-keeping and calculation tool for your personal finances. You enter your own information — bills, income, expenses, budgets, debts, payments, assets, savings goals, and crypto holdings — and Ajé organizes it, projects due dates and pay schedules, and calculates payoff timelines and budget totals.

Ajé is not a bank, lender, broker-dealer, investment adviser, tax preparer, credit counselor, or money transmitter. It does not hold, move, or transfer money, it does not connect to your bank or card accounts, and it does not pay your bills for you. Every figure Ajé shows is a calculation performed on numbers you supplied.

Section 3

Not financial, investment, tax, or legal advice

Ajé does not provide financial, investment, tax, accounting, or legal advice, and using Ajé does not create an advisory or fiduciary relationship between you and us. Projections, payoff schedules, budget suggestions, and any other output are informational calculations only — not recommendations to take or refrain from any financial action.

You are solely responsible for your financial decisions. Consult a licensed professional before acting on anything you see in Ajé, and verify amounts and dates against statements from your actual financial institutions before making a payment.

Crypto and asset valuations, where shown, reflect values you entered or that were retrieved from third-party sources. They may be delayed, inaccurate, or out of date, and they are not quotes, offers, or appraisals.

Section 4

Eligibility

You must be at least 16 years old to use Ajé and must have the legal capacity to enter into this agreement. If you use Ajé on behalf of an organization, you represent that you are authorized to bind that organization to these Terms.

You may not use Ajé if you are barred from doing so under the laws of the United States or your country of residence, or if you are on a US government restricted-party list.

Section 5

Your account

An account is required so your records persist and remain private to you. Sign-in is handled by our authentication provider, Clerk. You are responsible for:

• Keeping your sign-in credentials confidential and securing the email address and any Google or Apple account used to sign in.
• All activity that occurs under your account, whether or not you authorized it.
• Notifying us at support@ajemoney.app promptly if you believe your account has been accessed without your permission.
• Providing accurate account information and keeping it current.

Do not share your account with others or create an account for anyone else. One person, one account.

Section 6

Acceptable use

You agree not to:

• Use Ajé for any unlawful purpose, including money laundering, fraud, tax evasion, or concealing the proceeds of crime.
• Enter another person’s financial information without their permission, or upload data you do not have the right to use.
• Attempt to access another user’s account or records, probe or bypass authentication, or interfere with the service’s security.
• Scrape, crawl, or use automated means to access Ajé outside of the interfaces we provide, or use it to build a competing product.
• Reverse engineer, decompile, or attempt to derive source code, except to the extent that restriction is unenforceable under applicable law.
• Place unreasonable load on the service, including excessive imports, bulk automated requests, or denial-of-service activity.
• Upload malware, or content that is defamatory, harassing, or infringing.
• Resell, sublicense, or provide Ajé to third parties as a service.

Section 7

Your data

The financial records you enter remain yours. We claim no ownership of them. You grant us only the limited license needed to operate the service: to store, process, back up, and display your records to you, and to perform the calculations you asked for.

We do not sell or share your data, and we do not use it to train artificial intelligence or machine learning models. You can edit or delete any record at any time, and deleting your account removes your data as described in our Privacy Policy.

You are responsible for the accuracy of what you enter. Ajé cannot detect a mistyped balance or a wrong due date, and its output is only as reliable as its input.

Section 8

Backups are your responsibility

We maintain operational backups for disaster recovery, but those are for restoring the service — not a personal archive for you, and not a guarantee that deleted or lost records can be recovered. Keep your own copies of any financial information you cannot afford to lose. We are not liable for data that is lost, corrupted, or unrecoverable.

Section 9

Third-party services

Ajé depends on third-party providers to operate. Their terms and policies apply to you in addition to these Terms, and we are not responsible for their acts, omissions, outages, or changes.

Section 10

Free service, no service level guarantee

Ajé is provided free of charge. There is no subscription, no payment, and no billing — if anyone asks you to pay for Ajé, it is not us.

Because it is free, Ajé carries no uptime commitment and no service level agreement. We may change, suspend, limit, or discontinue any part of the service — including the service as a whole — at any time. If we discontinue Ajé entirely, we will make reasonable efforts to give advance notice in the app so you can export your records.

Section 11

Our intellectual property

Ajé — its software, design, interface, calculation logic, name, and branding — is owned by us and protected by intellectual property law. These Terms grant you a personal, non-exclusive, non-transferable, revocable license to use Ajé for your own personal finances. No other rights are granted.

Section 12

Termination

You may stop using Ajé and delete your account at any time. We may suspend or terminate your account if you breach these Terms, if your use creates legal risk or harms other users or the service, or if we discontinue Ajé. Where practical and lawful, we will give notice and an opportunity to export your data first.

On termination, your license to use Ajé ends immediately. Sections 3, 7, 8, and 13 through 17 survive termination.

Section 13

Disclaimer of warranties

AJÉ IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT AJÉ WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT ANY CALCULATION, PROJECTION, DUE DATE, OR VALUATION IT DISPLAYS IS ACCURATE, COMPLETE, OR CURRENT.

Some jurisdictions do not allow the exclusion of implied warranties, so some of these exclusions may not apply to you. Nothing in these Terms limits any non-excludable statutory guarantee or consumer right you have under the law of your country or state.

Section 14

Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, SAVINGS, GOODWILL, OR DATA, ARISING OUT OF OR RELATING TO YOUR USE OF AJÉ — INCLUDING MISSED PAYMENTS, LATE FEES, OVERDRAFTS, PENALTIES, INTEREST CHARGES, OR CREDIT CONSEQUENCES — EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO AJÉ WILL NOT EXCEED ONE HUNDRED US DOLLARS (US$100).

Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above may not apply to you. Nothing here excludes liability for fraud, willful misconduct, death or personal injury caused by negligence, or any other liability that cannot lawfully be limited.

Section 15

Indemnity

You agree to indemnify and hold us harmless from any claim, demand, loss, or expense (including reasonable legal fees) arising from your misuse of Ajé, your breach of these Terms, your violation of any law, or your infringement of another party’s rights. This does not apply where the claim results from our own breach or negligence, and it applies only to the extent permitted by the law where you live.

Section 16

Governing law and venue

These Terms are governed by the laws of the State of Georgia, United States, without regard to its conflict-of-laws rules. You and we agree to the exclusive jurisdiction of the state and federal courts located in Fulton County, Georgia for any dispute arising out of these Terms.

If you are a consumer resident in the EEA, the UK, or another jurisdiction whose law gives you the right to bring proceedings in your local courts and to the protection of your local mandatory consumer laws, this section does not take those rights away from you.

Section 17

General

Changes to these Terms

We may update these Terms. When we do, we will change the “Last updated” date above, and for material changes we will give notice in the app before they take effect. Your continued use of Ajé after changes are posted constitutes acceptance of the updated Terms. If you do not agree, stop using Ajé and delete your account.

Severability and waiver

If any provision of these Terms is found unenforceable, it will be limited or removed to the minimum extent necessary and the remaining provisions stay in full force. Our failure to enforce a provision is not a waiver of it.

Assignment and entire agreement

You may not assign these Terms without our written consent. We may assign them in connection with a merger, acquisition, or sale of assets. These Terms and the Privacy Policy are the entire agreement between you and us regarding Ajé and supersede any prior understanding.

A DMCA notice must identify the copyrighted work, the material you believe infringes it and where it is located, your contact information, a statement of good-faith belief that the use is unauthorized, and a statement under penalty of perjury that your notice is accurate and that you are authorized to act for the rights holder.
